On March 29, 2023 Saban Legal Services, along with co-counsel Fair Work P.C., filed a class action lawsuit against the Barbara Lynch Collective, Inc. et al regarding the payment of tips. Massachusetts Law requires employers to remit all tips received from customers to their wait staff employees.

In our complaint we allege that in June of 2020 during the Covid-19 Pandemic the Barbara Lynch Collective, Inc., which consists of Boston restaurants such as Drink, B&G Oysters, Sportello, The Butcher Shop, Stir, No. 9 Park, and Menton, paid its employees solely with PPP funds granted from the government. During this time period the Barbara Lynch Collective, Inc. restaurants allegedly suspended their tip pool and instead diverted employee tips left by customers to a different fund. This case is pending in Suffolk Superior Court.
